Appraise the following 3 key issues which have now come to light taking each in turn and stating the issue, the rule of law, an analysis/application and then arrive at a conclusion. Now your client has purchased the property, he has noted that there is a negative covenant preventing the parking of more than 10 cars on the site and a positive covenant providing that a retaining wall with the adjoining property must be kept in repair by your client – it currently needs some £30,000 of work to it. Analyse what land covenants are and provide the purchaser with some advice over whether either or both of these covenants are still enforceable. (Approximately 800 words)
